Goldman Ismail Wins Summary Judgment for Imerys Talc

Goldman Ismail achieved an important victory on behalf of its client Imerys Talc (f/k/a Luzenac America, Inc.) in the Federal District Court of South Dakota.  In Berg v. Johnson & Johnson et al., the plaintiff alleged that she contracted ovarian cancer due to her use of Johnson & Johnson products that contained talc, a naturally-occurring mineral that is sold by Luzenac.  Recently hired as trial counsel, Goldman Ismail’s first task was to ask the Court to reconsider its original denial of summary judgment on the sole remaining claim against Imerys.  On July 22, 2013, the Court agreed with the arguments made by Goldman Ismail and granted the motion for reconsideration.  The Court entered judgment in favor of Imerys, completing Imerys’ pre-trial victory.  The Goldman Ismail team was led by Shayna Cook.  Joe Tomaselli and Andrew Rima also worked on the case.
