Goldman Ismail Prevails on Summary Judgment in California State Court for Medtronic

On March 3, a California state court in Ventura County granted Medtronic’s motion for summary judgment dismissing all of plaintiff’s product liability and wrongful death claims. Plaintiff had claimed that Medtronic’s NIM nerve-monitoring tube substantially contributed to the plaintiff’s mother’s death. However, after approximately eighteen months of discovery, the Court found that the plaintiff’s expert was not competent to render opinions on medical causation and, as a consequence, that the plaintiff could not meet her burden of proof.
