U.S. Court of Appeals for the Seventh Circuit Grants Goldman Ismail’s Petition for Rehearing En Banc

On October 15, 2015, the U.S. Court of Appeals for the Seventh Circuit vacated its earlier ruling and granted an extremely rare rehearing en banc in favor of our client, Tyrone Petties, an inmate at Stateville Correctional Center. Mr. Petties brought suit against his treating physicians at Stateville alleging deliberate indifference to his serious medical condition, a ruptured Achilles tendon. The district court granted summary judgment against Mr. Petties in 2014, and on July 30, 2015, a divided Seventh Circuit panel affirmed that decision. Our petition for rehearing argued that the panel decision failed to apply the proper legal standard, overlooked key evidence, and conflicted with decisions from the Seventh Circuit and other federal appellate courts. Mr. Petties is represented pro bono by Rami Fakhouri. Rami will present oral argument before the full Seventh Circuit at a date to be announced.
