Goldman Ismail Obtains Summary Judgment for Medtronic in Another California SynchroMed Case

On May 7, 2018, the U.S. District Court for the Central District of California granted summary judgment on all remaining claims in a lawsuit filed against Medtronic. In a Complaint filed in September 2016, Plaintiff asserted that Medtronic’s premarket-approved SynchroMed® II pumps malfunctioned due to purported defects, causing her injury. After the Court granted Medtronic’s motions to dismiss with respect to all of Plaintiff’s product-liability claims, the case proceeded on a theory of alleged misrepresentation. After nearly a year of fact and expert discovery, the Court held there was “no evidence” to support key elements of the remaining misrepresentation claims.

The Court’s ruling resulted in a complete victory for Medtronic. Representing Medtronic from Goldman Ismail were Joe Tomaselli, Rami Fakhouri, and Mike Casner.
